These Terms and Conditions ("Terms") govern your use of the Motito platform and its associated services (the "Services"). Please read these Terms carefully before using the Services. By accessing and using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.
To be eligible to use the Services, you must be at least 18 years of age and reside in Ghana. By using the Services, you represent and warrant that you meet these eligibility requirements.
To access and use the Services, you are required to create an account with Motito. You agree to provide accurate, current, and complete information during the registration process and to promptly update this information as necessary to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
To comply with regulatory requirements and to provide a secure platform for our users, we require you to complete Know Your Customer (KYC) and identity verification processes. This includes providing personal information such as your full name, phone number, date of birth, gender, occupation/means of income, digital address (optional), and physical address, as well as verifying your Ghana Card details.
To determine your eligibility for our buy now, pay later service, we require you to complete income verification and credit scoring processes. This involves providing financial information from sources such as financial SMS receipts, internet banking, and PDF bank statements. We will use this information to assess your affordability and creditworthiness. Please refer to our Privacy Policy for more information on how we handle your personal data.
By using the Services, you agree to pay a 5% service fee on each transaction facilitated by Motito. Additional fees may apply for late payments, extensions, or other services as outlined in the specific terms for each service.
You agree to repay any outstanding amounts owed to Motito in accordance with the agreed-upon repayment schedule. Motito will send payment reminders and automatically deduct fees owed from your linked bank or mobile money account on the appointed repayment days.
In the event of default or delinquency, Motito reserves the right to take appropriate actions, including but not limited to: liquidating collateralized assets, reporting to credit bureaus, and pursuing legal remedies.

We have implemented various risk mitigation and customer protection measures to ensure a secure and trustworthy platform for our users. These measures include KYC and identity verification, income verification and credit scoring, fraud detection, security and restricted access, and dispute resolution.
Motito reserves the right to modify these Terms at any time. Any changes to these Terms will be posted on our platform, and your continued use of the Services following such changes constitutes your acceptance of the revised Terms.
Motito may terminate your access to the Services, at its sole discretion, for any reason and without notice. You may also terminate your account by contacting our customer support team. Upon termination, you remain responsible for any outstanding obligations related to your account.
These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions.
Any disputes arising out of or in connection with these Terms or the Services shall be resolved through negotiation between the parties. If the parties fail to reach a resolution within 30 days, either party may submit the dispute to arbitration under the rules of the Ghana Arbitration Centre. The decision of the arbitrator shall be final and binding on both parties.
In no event shall Motito, its affiliates, directors, officers, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use of the Services or any other matter relating to the Services.
You agree to indemnify and hold harmless Motito, its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Services or your violation of these Terms.
The Services are provided on an "as is" and "as available" basis, without any warranty of any kind, either express or implied. Motito disclaims all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Motito does not warrant that the Services will be uninterrupted, secure, or error-free, nor does it make any warranty as to the accuracy, completeness, or reliability of any information obtained through the Services.
All content, including but not limited to text, graphics, logos, and software, on the Motito platform is the property of Motito or its licensors and is protected by applicable intellectual property laws. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without the express written consent of Motito.
The Services may contain links to third-party websites or resources. You acknowledge and agree that Motito is not responsible or liable for the availability, accuracy, or content of such websites or resources, and you assume all risks arising from your use of such websites or resources.
These Terms, along with the Privacy Policy and any other legal notices or agreements published by Motito on the platform, constitute the entire agreement between you and Motito concerning the Services and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and Motito with respect to the Services.
The failure of Motito to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
